THE COURT: People of the State of Michigan versus Jerome George Frandle, 11 - 1-9-5-5-S-M. Mr Frandle is here with his lawyer Mr. Boyle. The People are represented by assistant prosecuting attorney Ms. Krohn. The matter is set for plea and sentencing today. And Mr Boyle at this time is Mr Frandle prepared to proceed with entry of his plea?

Mr Boyle: Yes, your honor.

THE COURT: And will Mr Frandle be pleading guilty or no contest?

Mr Boyle: No contest, your Honor.

THE COURT: Is that right Mr Frandle? You're prepared to plead no contest at this time?

Defendant Frandle: Yes it is, your honor.

THE COURT: And the basis for the no contest plea Mr Boyle?

Mr Boyle: Potential civil liability, your Honor.

THE COURT: Ms Krohn, do the People have any objection to a no contest plea?

Ms Krohn: No, your honor.

THE COURT: And Mr Frandle , have you had enough time to talk to Mr Boyle about everything?

Defendant Frandle: Yes sir, I have.

THE COURT: Do you still remember all of the constitutional rights that you have in this case that are set forth on the advice of rights form that you have previously signed and filed?

Defendant Frandle: I couldn't quote them but I have read.

THE COURT: You have an understanding of them?

Defendant Frandle: Yes sir.

THE COURT: And also you're represented by counsel as well. How do you plead to the charge of failure to report child abuse on or about the period of February 1, 2007 through February 8, 2007?

Defendant Frandle: No contest.

THE COURT: Do you understand that if the court accepts your no contest plea, you will not have a trial of any kind and you will give up all the rights that you would have at trial?

Defendant Frandle: Yes sir, I do.

THE COURT: Has anyone forced you to plead no contest?

Defendant Frandle: No sir.

THE COURT: Has anyone threatened you to get you to plead no contest?

Defendant Frandle: No sir.

THE COURT: Has anyone promised you anything to get you to plead no contest?

Defendant Frandle: No sir.

THE COURT: And Mr Frandle, are you pleading no contest of your own free choice?

Defendant Frandle: Yes.

THE COURT: The Court has a number of transcripts in the file. And the Court does have specific recollection of this matter. And in particular the February 10, 2012 hearing, which was conducted in this Court for the purpose of the Court determining whether or not Mr Frandle was subject to the act, that being MCL 722.6332. And as part of that hearing, there was substantial testimony as to whether or not the organization, which is known as The Faith as testified to by Ms Koning was, in fact, a religious organization of some type.

And number two, was Mr Frandle considered to be a clergy person in that organization. The Court found following the hearing that it was a religous organization or an organization that was subject to the reporting requirements under the statue. And then Mr Frandle, as I stated -- the Court found was in my view a clergy person or an official that fell under the act for reporting purposed. And so any objection to the Court using the transcript of that hearing Mr. Boyle?

Mr Boyle: No, your honor.

THE COURT: Ms Krohn?
